INSURANCE COVER

All members resident in the UK - including Northern Ireland, the Isle of Man and the Channel Islands, are able to apply for Public and Products liability Indemnity insurance. The policy issued by AXA Insurance UK Plc and provides indemnity against claims arising from non medical treatments performed by members who possess approved qualifications in such treatments. AXA Insurance UK Plc is authorised and regulated by the Financial Services Authority.

Membership based insurance schemes are organised by associations as a way of providing low cost insurance designed to meet the needs of their members. The insurance is written as a single policy to which all participation members contribute and as such there is a single renewal date occurring on 1st March each year - The policy renewal date remains the same irrespective of the date a member joins the scheme.

This document is a summary of the cover available under the Independent Professional Therapists International (IPTI) insurance policy underwritten by AXA Insurance UK plc. The summary contains some keys features and benefits of cover along with some significant exclusions and limitations on the policy. It also contains some general conditions and exclusions on the policy, how to make a claim, your cancellation rights and how to make a complaint. As this is a summary it does not contain the full terms and conditions of your insurance. You can find the full terms and conditions of cover in your Policy Document. Treatment Public & Products Liability
Covers your legal liability in connection with Your business to members of the public for accidental injury or accidental damage to material property. There are 2 standard limits of indemnity £1m or £2m any one incident

Limit of Indemnity - Advanced Electrolysis
Provides cover for injury or loss or damage for claims first made in writing during the policy period arising out of an advanced electrolysis treatment. The maximum limit of indemnity is £500,000 any one claim and in total during the policy period.

Indemnity to principals and salon owners
Covers You and any principal or salon owner for whom You are
providing services.

Contract Liability
Provides cover for liability You have assumed under contract or agreement as long as the Company (AXA Insurance UK plc) retains sole conduct and control of any claim and the contract or agreement does not apply in connection with Products.

Assistance Clause
Provides cover for accidental injury to any person not engaged in your service and accidental loss or damage to material property not belonging to You as the Insured, as a result of you or your employees acting to assist injured parties or prevent injury to third parties. The maximum amount payable for any claim or claims resulting from one cause is £100,000

Car Park Liability
Provides cover for loss or damage to vehicles owned by others but held in the trust or under the custody of You as the Insured provided that they are not being stored for a fee and are not being held for the purposes of work being carried out upon them.   

Optional Extension 1
This extension increases the limit of indemnity to £5m in respect of the Public Liability aspect of the cover. The limit of Indemnity in respect of Treatment liability or Products Liability cannot be increased to £5m

Injury to any employee.

The first £100 for loss or damage to third party property occurring at the business address and the first £200 for loss or damage to third party property occurring at any other address

Cover under Limit of Indemnity - Advanced Electrolysis is restricted to claims occurring after a certain date known as the retroactive date. This would normally be the date cover commenced under the policy and it will be shown on the schedule. This means that claims notified after the inception date of the cover must also relate to treatments that were undertaken after the retroactive date shown on the schedule.

Error or omission in advice given or treatment undertaken.

Costs involved in recalling any product.

Work in aircraft or at any airport (aircraft access areas only).

Excluding cover for teaching unless specifically agreed by the Company

Treatment given by any person under the age of 16 or by any person who is not qualified in the treatment being given.

Treatment of the eyeball or conjunctiva, veins, removal of warts or moles, ingestion of aromatherapy oils.

It is a requirement that protective sheeting is placed on the floor whenever work is carried out in a client's home.

Client's who have medical conditions that might be affected by the treatment cannot be treated without the written permission of the client's own doctor.

Therapists must keep complete records of the client and the treatments given, including aftercare advice, for at least 6 years after the last occasion that a treatment was given.

Wherever aftercare is required, written advice regarding such aftercare must be given to each client on every occasion that the treatment is provided.

Specific requirements exist in respect of certain treatments and these are contained in the policy wording, a copy of which is available on request

All risks provides cover for Your business equipment against loss by any accident or misfortune

The first £200 of each claim

Loss or damage by theft unless involving forcible or violent entry or exit form the Premises.

Wear and tear

Loss from an unattended motor vehicle unless the vehicles is locked at all points of access   and stock and equipment is out of sight. An anti-theft alarm must be fitted and working and equipment and stock must be removed from an unattended vehicle outside of business hours. Loss of   any item over £5000 unless specified on the certificate.

General Policy Exclusions and Conditions

  • Application of heat, other than in respect of items normally found in a salon, is excluded.
  • You are required to take reasonable precautions to prevent loss or damage occurring.
  • Any alterations in the risk must be advised to IPTI as failure to do so could mean that the policy is invalidated.
  • Any incident that may give rise to a claim must be notified immediately as it occurs and all written correspondence regarding any claim must be forwarded to AXA Insurance UK plc without acknowledgement. You must not admit fault or liability.
  • The Policy shall be voidable in the event of misrepresentation misdescription or non-dislosure of any material fact. If in doubt about whether a certain fact is material then this information should be disclosed.

Minimum Standards of Security

It is a condition precedent to the Companys (AXA Insurance UK plc) liability for loss destruction or damage by theft or any attempt thereat that the following minimum level of security (or alternative security protections as agreed in writing by the Company whether following a survey or otherwise) is installed at the Premises and put into effect whenever the Premises is left unattended

a) the final exit door of the Premises is to be fitted with a mortise deadlock which has 5 or more levers and/or conforms to BS3621    A matching boxed striking plate must also be fitted

b) all other external doors and all internal doors giving access to any part of the building not occupied by the Insured for the purpose of the Business are to be fitted with either

i) a mortise deadlock which has 5 or more levers and/or conforms to BS3621 with a matched boxed striking plate as specified above

or

ii) two key operated security bolts for doors one fitted approximately 30 cm from the top of the door and the other 30 cm from the bottom

c) aluminium or UPVC framed doors are to be fitted with integral cylinder key operated mortise deadlocks

d) all opening external basement ground floor and other accessible (accessible being a window that can easily be reached such as a window adjacent to a flat roof or a fire escape balconies canopies or down pipes) windows fanlights rooflights and skylights are to be fitted with key operated window locks. This requirement does not apply to windows protected by solid steel bars weldmesh or expanded metal grilles securely fixed to the brickwork surrounding the window

e) any door or window officially designated a Fire Exit by a fire authority is excluded from the above requirements these are to be secured internally by panic bolts or fire exit bolts (capable of opening at all times) any additional devices must be approved by the local Fire Prevention Officer

Making a Claim

In the event of any occurrence which may give rise to a claim under this Policy the Insured shall:

a) On the happening of any loss damage injury or accident give notice in writing to the Company (AXA Insurance UK plc) or HSBC Insurance Brokers Ltd and shall at his or her own expense within thirty days after the happening of such loss or damage injury or accident deliver to the Company or HSBC Insurance Brokers Ltd a claim with all the detailed proofs and particulars that may be reasonably required.

b) Immediately forward to the Company (AXA Insurance UK plc) upon receipt of every letter claim writ, summons or process

c) Immediately notify the Company (AXA Insurance UK plc) of any knowledge of impending inquest or inquiry

d) Make no admission or promise payment of indemnity on behalf of the Insured without written consent of AXA Insurance UK plc

e) Not incur any expense in making good any damage without written consent of AXA Insurance UK plc

Making Yourself Heard

Any complaint You may have relating to your policy should in the first instance be addressed to Independent Professional Therapists International via the address on the front of the policy. If your complaint relates to a claim on Your Policy then contact whoever is currently dealing with your claim and state your complaint. If you are not satisfied with the way in which your complaint has been dealt with, you should write to the Customer Care Department of AXA Insurance. If the complaint is still not resolved, you can approach the Financial Ombudsman Service. The Ombudsman will only consider complaints if:
- We have provided you with written confirmation that our internal complaints procedure has been exhausted
- Your business has a turnover of less than £1,000,000
Referral to the Financial Ombudsman will not affect your right to take legal action.

Your Cancellation Rights

You may cancel the Policy in the first year of insurance during the 14 days after the contract has been concluded by giving notice in writing to Independent Therapists International to the address on the front of the Policy. This right does not apply at the first or any subsequent renewal of the Policy. During this 14 day period AXA Insurance UK plc will give a refund for the proportionate part of the premium paid in respect of the unexpired term of this policy subject to this proportionate part being in excess of £50. This is subject to no claims being made under the Policy for which a payment has been made, no claims made under the Policy which are still under consideration and no incidents likely to give rise to a claim but are yet to be reported.

Data Protection

AXA Insurance UK plc is a member of the AXA Group. In order to supply your quotation and then to set up and administer your insurance policy we will hold and use information including sensitive personal data (such as criminal convictions and health information) you have provided and may send it in confidence for secure processing to other companies in the AXA Group (or companies acting on our instructions) including those located outside the European Economic Area.

We also share your information and any subsequent claim information with other insurers, via the Claims and Underwriting Exchange Register run by Insurance Database Services Ltd to check insurance details and prevent fraudulent claims. By purchasing this policy, you consent to such use of your personal data.

Policy Duration

This is an annually renewable policy

Law Applicable

You and We as AXA Insurance UK plc are free to choose the laws applicable to the Policy. As We are based in England We propose to apply the laws of England and Wales and by purchasing this Policy You have agreed to this.
